FDA Registration and Guidelines
Complying with the Bioterrorism Act of the United States - Starting December
12, 2003.

The
Law:
The United States has a new law, the Bioterrorism Act, to protect the food
supply from being contaminated by terrorist acts. The U.S. Food and Drug Administration
(FDA) is the United States Government agency with the responsibility to
implement the Bioterrorism Act. The FDA will require: (1) registration of
all food facilities, (2) prior notice of imported food, (3) administrative
detention of food, and (4) establishment and maintenance of records regarding
food. Please note: The term "food" means any and all food or
beverage items consumed by people or animals including dietary supplements,
bottled water, candy, etc.
Who
is Affected:
The Bioterrorism Act
requires any and all foreign companies that manufacture, process, pack, or
hold food for human or animal consumption in the United States to register with the
FDA no later than December 12, 2003. Non-United States companies with
multiple operations must register each facility separately.
In addition, all companies
located in the United States which manufacture, process, pack, transport,
distribute, receive, hold, or import food and beverages intended for human or
animal consumption in the United States also must register with the FDA by
that date.
Timeline:
The proposed
regulations by the FDA were issued in January 2003 and May 2003, and the
Final Interim Regulations for registration of facilities and prior notice
submissions were issued on October 10, 2003. The effective date of the
regulations is December 12, 2003. As of December 12, 2003, all companies
involved in the manufacture, processing, holding, and storage of food and
beverage items into and within the United States must be registered
with the FDA and must timely submit properly completed prior notice submission
form information to the FDA.

Penalties:
The
Bioterrorism Act makes failure to register a prohibited act. The Federal
government can bring a civil action in Federal court to enjoin persons who
commit a prohibited act; or the Federal government can bring a criminal
action in Federal court to prosecute persons who are responsible for the
commission of a prohibited act.
Failure to register with the FDA and
present a timely prior notice submission to the FDA for each particular
shipment will result in the merchandise being refused detained or refused
admission into the United
States. The importer or carrier will be
responsible for any accrued storage charges for the detained or refused
merchandise, and for the costs of destruction.
United States Agent:
Every facility located outside the United
States which registers with the FDA must designate a
"United States
agent" located in the United
States.

voluntary basis, with members of the trade community. CBP and willing members
of the trade community collaborate to better secure the international supply
chain to the United States
in support of CBP’s priority Homeland Security
mission. C-TPAT is one of CBP's initiatives that
help the agency achieve its twin goals: security and facilitation of trade
moving into the United
States.

Frequently exporter and importers forget that the
international rule for business engagement is based on “INCOTERMS”, a series of clear specification of
roles, risk, responsibilities and transfer of ownership.
All written and verbal agreements must indicate the agreed
clause that will control the transaction. There is no “default” clause.
